A High Court challenge to the adoption of the Welwyn Hatfield Local Plan has been successfully defended by the borough Council.

The case, challenging the lawfulness of the adoption of the new Local Plan for the borough was brought by Aurora Properties.

However, before the court began considering the grounds of challenge, the council and the Secretary of State for Levelling Up, Communities and Housing, pointed out to the court the claim had not been lodged and served within the required time period.

The matter was considered at a hearing at the High Court before Mr Justice Mould who found the time period had elapsed, which made the challenge inadmissable.

Cllr Rose Grewal, executive member, planning, for Welwyn Hatfield Borough Council, said: “We are pleased that the challenge to the Local Plan has been successfully defended, and we are now looking forward to continuing the work to deliver the new homes and benefits that the plan will bring.”
