Spelthorne Council has obtained liability orders for unpaid Community Infrastructure Levy (CIL) in two cases where developers did not fulfil their statutory obligations.

In the first case, Shedan North Ltd, responsible for a development at 18 Wellington Road, Ashford, failed to submit the necessary CIL documents and make payments. Consequently, a liability order for £29,285.10 was issued on 10 February 2026, with interest accruing until full payment.

Additionally, Shedan North lost an appeal in November 2025 concerning a development at 66 Gordon Road, Ashford, Surrey, under section 78 of the Town and Country Planning Act 1990. The appeal was dismissed as it conflicted with the development plan, and no material considerations justified a different decision.

In the second case, Karenor Properties Ltd, which was involved in a development at 15 Station Road, Ashford, also failed to comply with the CIL process and to make timely payments. A liability order for £55,265.85 was issued on the same date, with interest continuing to apply.

Cllr John Turner, chair of Spelthorne Borough Council’s Environment and Sustainability Committee, emphasised the importance of CIL contributions, stating: “CIL contributions are essential to funding local infrastructure such as roads, schools and community facilities that support new development. While we always seek to work constructively with developers, compliance with the statutory process is not optional. Where payments are not made, we will take appropriate action to recover the funds owed on behalf of our residents. “

CIL is a charge imposed on developers for new constructions, used by councils to fund necessary community infrastructure as areas expand.
