A hybrid application, containing an outline application for the erection of up to 250 dwellings, and a full application for the erection of 102 dwellings, has been allowed on appeal.

The scheme is for land east of Halfpenny Lane, in Wisbech, Cambridgeshire, and was brought forward by Seagate Homes, originally seeing refusal by Fenland District Council.

The main issues with the scheme involved the proposition of culverting a drain, and the impact of proposed ground raising and reshaping works upon neighbours.

Firstly, regarding the culverting of Halfpenny Lane’s drain, it was accessed that this would be necessary to facilitate construction of an access road for the scheme, and after examination it would comply with the councils current development plan strategy for flood risk, therefore there would be no conflicts with this proposition.

Secondly, with regards to the ground raising and reshaping works – which are required due to the land being within a Flood Zone 1 risk boundary – the inspectorate concluded that they wouldn’t harm the living conditions of neighbouring occupiers, and therefore wouldn’t have any conflict with policy.

Consequently, the scheme was approved on appeal.
